課程名稱:可刑罰性專題研究

一、課程內容:國家犯罪與國家道德

根據罪刑法定主義,犯罪的確認,直接依據在於國家所制訂的刑法。同時基於國家法律的一體性,其他法律亦為解釋刑法時不可抵觸的實證標準。一言蔽之,犯罪的確認權在於國家。然而,所謂國家之行為,事實上畢竟是人的行為,因此關於犯罪之確認,事實上也不免受制於立法者、司法者,亦即整體而言,執政者私人的利益立場。姑且不論,在適用法律的層次上,國家司法或行政機關擁有終局的決定權,更根本的是,基於民主體制之三權分立原則,不管對錯,國家可以透過立法工程宰制一切可能的對於正義的解釋空間。承此,不但在概念上,國家當然不會構成犯罪,對於執政層次之個人而言,除非其個人利益抵觸執政集團之利益(例如選票),否則也在國家立法以及國家司法的庇蔭下,事實上免疫於犯罪概念的糾纏。

Syllabus

Topic: The research on state crimes and state morality

According to “Nulla Poena sine Lege”, crime is directly identified and confirmed by the criminal law enacted by the Parliament. Meanwhile, for the integrity of the legal system, other laws should be treated as positive standards with which shall not be contradicted when we interpret the criminal law. In a word, the power to confirm a crime is controlled by the State. However, the so-called state action is in reality a human behavior. Therefore, the confirmation of a crime cannot help but be constrained by the personal interests of legislators and judges, or even the interests of the administration. Even if we put aside the fact that the administration or the judicial system owns the final decision-making power regarding the application of law, a more fundamental question is, the State dominates the interpretation of justice by legislation. Therefore, not only the state will not commit a crime theoretically. Any individual who is in power is also immune to be accused of committing crimes under the protection of the legislation and the judicial system, unless her/his personal interest contradicts to the interests of the administration.

課程目標
法律理論及其周邊的社會理論,意義固然在於揭穿與矯正執政者藉國家之名巧取特定私人或特定階層利益,但是諷刺的是,短期而言,此等正義理論的效益事實上取決於執政者對於其私人利益的讓步,因此社會正義越需要理論支援的時候,理論的效益越是趨近於零。到最後,理論只能在一個角度上有其殘存的的意義,亦即教育。當然,與上述問題所呈現相同的困境是,國家體制下的教育工程畢竟還是會回到執政者個人利益的考量。因此,國家體制下的公民教育,功效有限。也難怪,最後一個浪漫的訴求依然是道德教育。

Legal theories and their relevant social theories are all intended to correct and prevent those in power from defending particular private or class interests. Ironically, in the short term, the effectiveness of justice theories actually depends much on the concessions those in power make on their private interests. That is to say, the more social justice needs a theory to support, the less the effectiveness of this theory is. In the end, the theory remains meaningful only for educational purpose. Of course, the dilemma presented in the above-mentioned problem is that the national educational system will in line with the personal interests of those in power. Thus, the effectiveness of the public education system is limited. No wonder that the last romantic solution is still the moral education.

成績評量
(口頭及書面)報告占百分之六十,上課及參與其他報告題目之討論狀況占百分之四十。

備註:計入刑事法學組、公法學組及基礎法學組學分。

Evaluation

Students’ evaluation will depend on (oral and written) papers presented by students and (60%) and their class participations and discussions (40%).

Credit Requirements
This course will satisfy the credit requirements of the Division of Criminal Law, Administrative Law and Fundamental Legal Study.
